Klub Capital Technologies Ltd. (hereinafter referred to as “We”, “Us”, “KCTL” or “Our” which expression shall mean and include its affiliates, successors and permitted assigns). Your (“You” or “Your”) use of the Platform (defined below) is subject to the notices, terms and conditions set forth in these Terms of Use. The domain name “www.klubworks.com” (hereinafter collectively referred to as the “Platform”) is owned and operated by KCTL under FSRA licence no. 220119.
Your use of the Platform is governed by the following terms and conditions (“Terms of Use”) as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. You acknowledge and agree that You shall be subject to the policies that are applicable to the Platform and by mere use of the Platform, You shall be contracting with KCTL and these Terms of Use (including the incorporated policies) shall constitute Your binding obligations.
We reserve the right, at Our sole discretion, to change, modify, add or remove portions of these Terms of Use at any time without prior written notice. It is Your responsibility to review these Terms periodically for updates. We will notify You of any material changes via email or a Platform notice. Continued access following such notification shall constitute Your acceptance of the revised Terms.
ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR ACCEPTANCE OF ALL THE TERMS AND CONDITIONS IN THESE TERMS OF USE. IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE DO NOT USE THE PLATFORM.
1. What We Do
1.1 We provide a digital platform through which UAE-based businesses (“Brands“) can access financing and settlement solutions directly integrated with their online sales channels. Through the Services, we facilitate instant settlement advances, credit-push draws, and related tools.
2. Platform & Account
2.1 Access Without Registration: You may browse certain public pages without creating an account.
2.2 Registration: To use any financing or dashboard features, You must register by providing complete, accurate information and complete our FSRA-mandated KYC process.
2.3 De-activation: You may deactivate your account at any time by emailing uaesupport@klubworks.com. Any outstanding obligations under these Terms will survive de-activation.
3. Definitions
“Advance“ means any instant settlement or credit facility provided by KCTL.
“online Account“ means the linked online merchant account used to verify weekly sales.
“Fees“ means all profit rates, processing charges and other amounts you owe under these Terms.
4. Service Descriptions & Fees
4.1 Instant Settlement Advances: Receive your weekly settlement within 24 hours (instead of 8–15 days). Profit Rate: 1% of the drawdown amount per week. Processing Fee: AED 10 per disbursement.
4.2 Credit Push Facilities: Draw up to 80% of projected settlement amounts, automatically “pushed” to your bank. Profit Rate: 1.0% per cycle. Repayment: Automatically offset against your next settlement.
All Fees and rates are disclosed on-screen before You confirm any transaction. We may adjust rates upon 7 days' written notice to You.
5. User Obligations & Conduct
5.1 Safeguard your login credentials and notify KCTL immediately of any suspected unauthorized access
5.2 Use the Platform only for lawful purposes—no fraud, money-laundering or illicit activity.
5.3 Keep your registration and contact information up to date for regulatory compliance.
6. Disclaimers & Limitation of Liability
6.1 Licence & Regulation: KCTL holds FSRA licence no. 220119 and is regulated by the Abu Dhabi Global Market.
6.2 “As-Is“ Basis: Services are provided “as is“ without warranties of any kind.
6.3 Liability Cap: Our total aggregate liability will not exceed the total Fees paid by You in the preceding 12 months. We disclaim liability for indirect, incidental or consequential damages.
7. Confidentiality & Data Protection
7.1 We treat all Customer data as confidential and only disclose it to: ADGM FSRA or other regulators on lawful request, Third-party service providers under NDA, As required by law or court order.
All personal data handling is governed by our Privacy Policy.
8. Amendments to Terms
8.1 We may amend these Terms to reflect changes in FSRA rules or Platform offerings.
8.2 Material changes shall be communicated at least 7 days in advance. Continued use after the effective date constitutes acceptance.
9. Governing Law & Dispute Resolution
9.1 These Terms are governed by the laws of ADGM.
9.2 Any dispute will be settled by arbitration under the ADGM Arbitration Regulations, with the seat in Abu Dhabi.
